Terms and conditions of use
1. Presentation and Purpose
Wougo LLC (“Wougo”) is an online platform enabling users to compare and access mobility services, including transportation, moving, packing and related services.
Wougo acts exclusively as a comparator and does not provide any of the services displayed on the platform. Services are provided by third-party service providers, independent of Wougo, with whom users contract directly.
These General Terms and Conditions of Use (GTCU) define the rules for accessing and using the platform and the rights and obligations of users and service providers.
By accessing the platform and using the services offered, you acknowledge that you have read, understood and accepted these T&Cs without reservation.
2. Definition of Terms
In the context of these GCU, the following terms have the following meanings:
Wougo: Wougo LLC, the company operating the platform that brings users and service providers together.
User: Any individual or legal entity accessing the platform to search for a service provider.
Provider: Any professional or company registered on Wougo to offer its services.
Request for quotation: Request submitted by a user to obtain quotations for a mobility service.
Personal space: Interface for service providers to manage their information and requests.
Service area: Geographical perimeter defined by a service provider to receive quote requests.
Pricing: Cost of service applied to service providers wishing to appear on the platform.
3. Platform operation
3.1 Access and use
Access to Wougo’s services is free of charge for users seeking a quote.
Service providers must register and take out a subscription in order to be visible and receive requests for quotes.
3.2 Wougo’s role
Wougo acts as a comparator and facilitates contact between users and service providers.
Wougo does not directly provide the posted services and is not responsible for their performance.
Users are free to select a service provider and enter into a contract directly with them, without Wougo’s involvement.
3.3 No Warranty
Wougo does not guarantee:
- The quality or availability of service providers,
- The accuracy of information provided by service providers,
- The culmination of transactions between users and service providers.
Any complaint relating to the performance of the service must be addressed to the service provider concerned.
4. Account Creation and Responsibility
4.1 Registration and security
Users and service providers must create an account by providing accurate, complete and up-to-date information.
Each account holder is responsible for the confidentiality of his or her identifiers and any use made of his or her account.
In the event of suspicion of fraudulent use, Wougo must be informed immediately.
4.2 Obligations of Service Providers
The service providers undertake to :
- Maintain accurate information on their activity,
- Comply with legal and regulatory obligations,
- Respond to requests for quotes in a clear and professional manner.
In the event of non-compliance, Wougo reserves the right to suspend or terminate access to the service.
5. Pricing and financial terms
5.1 Business model
Use of the platform is free of charge for users seeking a quote.
Service providers pay a subscription fee to be listed and to receive requests for quotes.
5.2 Payment and invoicing
The subscription fee is set at the time of registration and may vary according to the services subscribed to.
Payment is made by direct debit or by any other means accepted by Wougo.
6. Intellectual Property
All content on the platform (text, images, logos, software, algorithms) is protected by intellectual property rights and is the exclusive property of Wougo or its partners.
Any unauthorized reproduction, modification or use is strictly prohibited.
7. Liability and Limitations
7.1 No liability
Wougo is not involved in the provision of services and cannot be held responsible for the following:
- Cancellation, delay or poor performance of services,
- Damage or loss resulting from the intervention of a service provider,
- Non-compliance with contractual obligations between a user and a service provider.
7.2 Limitation of liability
To the extent permitted by law, Wougo’s liability is strictly limited to the comparison services provided.
Wougo cannot be held responsible for indirect losses or commercial disputes between users and service providers.
8. Disputes and Applicable Law
8.1 Settlement of disputes
As Wougo is not involved in the provision of services, any dispute between a user and a provider must be settled directly between them.
In the event of a dispute with Wougo, the parties agree to seek an amicable resolution before taking any legal action.
8.2 Applicable law and jurisdiction
These TOU are governed by the laws of the State of Delaware, USA.
In the event of litigation, the competent courts will be those of Delaware, United States.
9. Account Suspension and Termination
Wougo reserves the right to suspend or terminate an account in the event of :
- Misrepresentation or fraud,
- Violation of these GTU,
- Abusive or illegal use of the platform.
This decision may be taken without notice or compensation.
